In plain words.
These terms apply when you create an account or use The Image Chimp.
The service
The Image Chimp provides automated photo focus suggestions, content descriptions, tags and metadata exports through a local companion. Results can be wrong or uncertain. You remain responsible for selection, editing, publication, backups and deletion decisions. We do not guarantee that an image is suitable for a particular client, print size or purpose.
Your account and content
Use an email address you control. You must own or have the necessary permission to process each photo and its prepared image evidence. You retain your rights to your content. You give us permission to process it through the service and its providers solely to deliver, support and secure the requested work.
Do not submit illegal material, attempt to bypass account boundaries, abuse free trials, interfere with the service, or use it in ways that violate provider requirements. A paid account may be opened only by a person who is at least 18, or by an authorized buyer acting for an organization.
Where we sell
Initial paid sales are available only to customers in the 50 United States and the District of Columbia. US territories are not included at this time. Prices and payments are in US dollars. Displayed prices exclude applicable tax; any tax charged will be shown before payment.
Credits and subscriptions
Standard uses one credit per completed photo review. Optional Turbo uses 2 credits per photo for faster cloud processing. The companion shows the mode and credit total before starting. Processing reserves the chosen amount; failed reviews automatically return that full amount. A RAW and JPEG with the same filename stem in the same folder count as one paired photo, reviewed from the RAW. Files catalogued separately count separately. Purchased credits do not expire. Monthly plans add the stated number of credits after each successful payment. Unused credits remain after cancellation. Local results and exports remain on your computer.
Cancellation
Subscriptions renew monthly at the displayed price until canceled. Cancel through the account billing portal before the next billing date. Cancellation takes effect at the end of the current paid or promotional period. If you cannot use the portal, email [email protected] from your account email and ask us to cancel. Top-ups are separate, deliberate purchases. We do not automatically charge for top-ups or overages.
Refunds
Your first paid purchase is eligible for a full refund when you request it within 14 days, even if you tried the service. A free promotional period does not use this first-purchase guarantee. A later payment, including a subscription renewal, is eligible for a full refund when you request it within 14 days and no photo review has been completed since that payment was made.
Request a refund by emailing [email protected]. Include the email address on your Image Chimp account and the receipt or payment reference. Never send a full card number or attach photos. Approved refunds return to the original payment method. Bank processing time varies, so we cannot promise the date the funds will appear.
A full refund reverses the credits from that payment exactly once. If those credits were already used, your balance may become negative; we will not automatically charge you to settle that balance. Partial refunds are reviewed by OVERKILL INC. A refund does not cancel a subscription. Cancel separately through the billing portal, or include a cancellation request in your email.
Failed technical reviews return credits automatically; that is separate from a payment refund. Billing errors, service failures and rights or remedies required by applicable law are handled separately and are not limited by this 14-day policy.
Promotions
If we offer a promotion, its eligible customers, duration and credit allowance will be stated with the offer. Promotional codes have no cash value and cannot be combined unless the offer says otherwise. After a stated free or discounted period, the normal displayed price applies. Cancel before the next billing date if you do not want the paid renewal. A promotion is available only when we expressly make its redemption available; these terms do not mean checkout or code redemption is currently open.
Availability and local storage
New reviews require an internet connection and available processing capacity. We do not guarantee a completion time. The companion keeps photos, metadata and results locally. You are responsible for backing up that workspace; we cannot restore your photo catalog from our server.
Review each proposed file action before applying it. Copying, moving and sending files to Trash can affect your local workflow and connected editing catalogs. Existing sidecars should be backed up before merging exported metadata. A focus label or generated tag is a suggestion, not an instruction to delete a photograph.
Our service processes prepared image evidence transiently. Google's processing retention applies as explained in the privacy policy. Failed technical reviews return their credits.
Changes and responsibility
We may update the service or future plan prices with reasonable notice. Paid credits retain their one-review value. To the extent allowed by law, the service is supplied without warranties beyond those expressly stated, and our liability is limited to the amount you paid for the service in the preceding 12 months. This does not limit rights or liabilities that cannot lawfully be excluded.
